There is no legal legislation or statute that may describe, regulate, or specify E-Pharmacy in India. In its current status, India's e-pharmacy industry is governed by the Drug and Cosmetic Act and Rules. The Ministry of Health and Family Welfare has published a proposal to change the Drug and Cosmetics Rules, 1945 in order to govern India's e-pharmacy industry. Along with the Drug and Cosmetic Act and Rules, E-Pharmacy businesses must also adhere to the Information Technology Act's rules and regulations.

The online pharmacy registration process in India is the legal procedure required to start an e-pharmacy (online medicine-selling business). In India, selling medicines online is strictly regulated because it involves public health, safety, and drug control laws. The process ensures that only authorized and qualified businesses can sell medicines through online platforms.

To start an online pharmacy, the first requirement is to register a legal business entity. This can be a sole proprietorship, partnership firm, LLP, or private limited company. Most online pharmacies prefer private limited companies or LLPs for better compliance and trust.

Next, the business must obtain a Drug License under the Drugs and Cosmetics Act, 1940. This license is mandatory for selling medicines in India. It is issued by the State Drug Control Department. There are two types of drug licenses:

  • Retail Drug License (for selling medicines directly to customers)
  • Wholesale Drug License (for selling medicines in bulk)

For online pharmacies, a retail drug license is usually required.

Another important requirement is appointing a registered pharmacist. The pharmacy must have a qualified pharmacist who supervises the sale and dispensing of medicines. This ensures that medicines are sold safely and only with proper prescriptions.

After obtaining the drug license, the business must also register under GST (Goods and Services Tax) if applicable. GST registration is necessary for tax compliance and invoicing.

The next step is setting up the online platform or website/app. The platform must comply with IT laws and data protection rules. Prescription medicines can only be sold after uploading a valid doctor’s prescription by the customer.

The government has also introduced draft rules for e-pharmacies through the Central Drugs Standard Control Organization (CDSCO), which regulates online sale of medicines in India. Companies must follow these guidelines carefully to avoid legal issues.

Many online pharmacies also need to ensure proper storage and delivery systems. Medicines must be stored in controlled conditions and delivered safely to customers without damage or misuse.

Popular online pharmacy platforms like Apollo Pharmacy and PharmEasy follow strict regulatory procedures to operate legally and safely in India.
