In general, the time limit (statute of limitations) to file a medical malpractice case depends on the jurisdiction, but commonly it’s:

  • U.S. states: Usually 1 to 3 years from the date of injury or from when you discovered (or reasonably should have discovered) the harm caused by medical negligence. Missing this deadline generally bars the lawsuit.

  • Example (typical U.S. rule): Many states allow about 2 years to file a malpractice lawsuit, with some states shorter (e.g., 1 year) or longer (e.g., 3 years) depending on local law.

  • India: For medical negligence claims, the limitation period is typically about 2 years from the date of the negligence or from when the injury was discovered; in civil courts it may be up to 3 years and in consumer forums usually 2 years under relevant limitation laws.
